As Americans search for ways to address rising economic inequality, strengthening the ability of workers to unionize without fear of reprisal may be one of the most important steps available. Unions were critical to building the middle-class in the United States—improving salaries and benefits for both union and nonunion workers—but today public sector unions are under attack from conservative governors and state legislatures around the country, and weak private sector labor laws allow corporations to fire those who seek to form a union and pay only small penalties. Should we amend the Civil Rights Act, which has powerful procedures and penalties, to ban discrimination based on union organizing?
